The employer sponsorship scheme enables Australian businesses to find suitably qualified and experienced staff within the Australian jobs Market to help them to expand their businesses. Under the Australian Employer Nomination Scheme (ENS) the employer can sponsor an overseas candidate to work in Australia with a temporary or permanent visa.
Overseas skilled workers may be sponsored by an Australian business or overseas business operating in Australia providing the candidate has the right skills, qualifications and work experience. The employer's location, position available and business needs will also be taken into account.
Positions offered under the Australian Employer Sponsored Visa Scheme must also correspond to an occupation on the Employer Nomination Scheme Occupation list (ENSOL).
In exceptional circumstances the Australian Department of Immigration may grant sponsored visas to individuals without 3 years post training employment, over the age of 45 or with less than vocational English.
The Australian government recognised at the end of 2008 that the right skills were not getting to the right areas of Australia. To remedy this announced they would be fast tracking sponsored visas going forward into 2009 to ensure the right people were being recruited to fill vacant jobs in Australia.

On 7th September 2009 senator Chris Evans, the Minister for Immigration and Citizenship, announced a requirement that temporary skilled overseas workers are paid market salary rates. This will ensure that subclass 457 visa holders are on the same wages and conditions of employment as those provided to an Australian worker undertaking the same role in the workplace. Employers have until January 2010 to comply or face large fines.
